On April 27, 2026, a deputy with the Miller County Sheriff's Office was working patrol in Tuscumbia when he responded to a reported assault in Miller County.
According to the probable cause statement, the reporting party contacted the deputy and stated that Justin David Hartwick had assaulted the victim at an RV park in Eldon. The report states the incident occurred after Hartwick allegedly had his dogs loose at the RV park.
The victim stated he informed Hartwick that RV park rules prohibited dogs from being off-leash or not penned. According to the probable cause statement, Hartwick then began cursing at the victim before the victim walked away. The victim reported that he then walked his dog down to a creek, and Hartwick followed him. An altercation occurred at the creek, and the victim was injured.
When the deputy contacted the victim on April 27, the deputy observed that the victimโs eye was black and blue from bruising. The victim also reported that his shoulder was sore. The deputy documented the victimโs injuries on a department-issued body camera.
The victim stated he had an appointment on April 28, 2026, in Columbia with a facial reconstruction specialist because of the severity of his injury. When asked why he did not contact law enforcement on April 26, the victim stated his lease for the RV campground said any contact with law enforcement would result in him being removed from the property.
During the investigation, the reporting party advised the deputy that Hartwick was walking on Highway 52 in Eldon. The deputy located Hartwick and placed him in custody with properly secured, double-locked handcuffs. While placing Hartwick in handcuffs, the deputy reported that Hartwickโs hands were swollen and had various scratches on them. The deputy then advised Hartwick of his Miranda rights.
Hartwick stated there were no witnesses and said the deputy needed to check cameras because they would show nothing. Hartwick did not wish to walk the deputy through the events of April 26. The deputy noted there would be no witnesses or camera footage because the assault occurred at a creek.
Hartwick is now charged with assault in the first degree.
