On May 17, 2026, deputies with the Boone County Sheriffโ€™s Office responded to South Old Plank Road at the Providence Landing Perche Creek Access in reference to a suspicious object found in the water.

According to court records, a boater reported finding a City of Columbia trash bin floating in Perche Creek and noted a strong odor of decomposition. Deputies responded to the area and accompanied the boater to the location of the bin. The bin was moved to the bank and opened, revealing the body of an adult human inside.

Investigators subsequently obtained surveillance images showing a red Chevrolet S-10 pickup truck traveling on Burr Oak Road near Star School Road on May 11, 2026, entering the Eagle Bluffs Conservation Area. The images showed a City of Columbia trash bin lying on its back in the bed of the truck. Investigators noted that the recovered trash bin containing the body had similar unique characteristics to the bin visible in the surveillance images and determined the recovered bin was consistent with the one observed in the truck bed.

On May 18, 2026, at approximately 8:30 p.m., law enforcement conducted a traffic stop involving the red Chevrolet S-10 pickup. Andrew Berry Acton was identified as the driver. Investigators reported that Acton appeared similar to the driver depicted in the surveillance images.

During a post-Miranda interview, Acton told investigators he could not remember details of May 11, 2026, other than that he drove around throughout the day. Investigators stated that despite being given multiple opportunities to address the allegations, Acton did not deny disposing of the trash bin containing the body.

Court documents also allege that between Oct. 1, 2025, and May 10, 2026, in Boone County, he knowingly or purposely caused the death of the victim by strangulation or smothering.

Acton is now charged with second-degree murder, abandonment of a corpse, and tampering with physical evidence in a felony prosecution.
